BBL: Insolvency proceedings opened against operator of Sofitel in Berlin (HAB-Betriebs GmbH)

02.10.2020: On October 1, the district court of Berlin-Charlottenburg opened insolvency proceedings over the assets of HAB-Betriebs GmbH, the operator of the Sofitel Hotel in Charlottenburg, and, as expected, appointed the previously appointed preliminary insolvency administrator Christian Graf Brockdorff from the restructuring law firm BBL Brockdorff & Partner as insolvency administrator.

„Thanks to a corresponding agreement with the landlord, business operations can be maintained despite the Corona crisis even after the insolvency proceedings have been opened,“ says Christian Graf Brockdorff.

At a staff meeting held on September 30, 2020, the employees were informed about the current status of the search for investors and the planned continuation of the hotel. There are currently several interested parties for a takeover of the hotel operation. „We are confident that we will be able to award the contract to one of the interested parties in the course of October 2020 and assume that the vast majority of the employees will be able to stay on board,“ said the representative of the lessor, Mr. Sascha Feies, attorney at law (GÖRG Partnerschaft von Rechtsanwälten mbB, Berlin).

„The hotel is and remains open, the restaurant Le Faubourg continues to offer its guests the popular lunch menu, the lounge bar is also open and we are pleased that the event business can also take place again, at least to a limited extent,“ says hotel director Stefan Winistörfer.

It is planned to transfer the business operations to a new operating company on November 1, 2020. This would secure the hotel’s long-term prospects. At the end of June, HAB-Betriebs GmbH had filed for insolvency at Charlottenburg District Court due to insolvency, as the court officially announced on 29 June 2020.
